Buyer's Agreement

Completing Registration, You agree to and understand the following terms and conditions:

1)  Once you enter your password, you should log in to the Members Area, and review your account information to ensure accuracy.

2) All sales are final. No refunds will be issued. All merchandise is sold "as-is", with no warranty, written or implied. Buyers entering into this agreement by registering with us are fully responsible for any and all bids they place in ParkModelAuctions.com's online auctions. This means bid carefully! Your electronic bids are binding, and you will be held liable for bids placed with your account. Think hard about who you share account login info with.

Once a bid has been placed online, and the auction closes, you are agreeing to be held personally liable for the bid amount, and any other fees or applicable taxes specified in the item description. If you renege on payment of your winning bid(s), then you will be sued for collections fees, reasonable attorney's fees and court costs to recover the payment in a Wisconsin court of law. By bidding online, you acknowledge that you have read and understood the terms and conditions in the online listing(s) that you are bidding on. Once the system accepts your online bid, and the auction closes, you have entered into a binding contract with seller, and are obligated to pay for your winning bid(s).  You are also responsible for state and/or local taxes and any transportation fees.

3) If you make a bidding mistake, it's OK. Call our office M-F 9am-5pm at 507-387-9473, and we will be happy to help you fix any mistakes. If staff members are busy with other customers, leave a message and someone will return your call as soon as possible. Remember, act quickly - don't wait until it's over.

4) Our website uses Dynamic Ending Times for online auctions. This means that the ending times of the auctions will end automatically.  Make sure to keep your eye on the closing time.

5) Disconnected and incomplete telephone numbers make us suspicious, since we don't charge a fee to register here. Please keep this in mind, and make sure to keep your contact info up to date, if you want to continue doing business with us. Also, if you don't follow the payment and removal terms described in the auction listings, your account may be suspended, so be sure you read the descriptions carefully.

6) All Bidders are required to pay for their purchases immediately upon receipt of an email invoice (printable) or paper invoice. You agree to pay the full amount of your invoice within seven (7) business days, unless otherwise noted in the payment terms of an auction description.

7) Terms of Sale: ParkModelAuctions.com. reserves the right to suspend or cancel your member account for any reason, at any time. ParkModelAuctions.com also reserves the right to cancel or postpone any auction item at our discretion. All vehicles and merchandise sold on this site is sold "As-Is," with no warranty, expressed or implied, including but not limited to: any warranty of fitness for a particular purpose or merchantability. Information and photographs provided in online auction listings is for bidder convenience only.

ParkModelAuctions.com Company Policies 

I) Items not paid for within the required time period will be offered to the backup bidder(s) and/or relisted in the online auctions. The bidder who did not pay will be banned from all future auctions.  We reserve the right to offer any merchandise that was reneged on to any qualified buyer in order to satisfy the needs of our selling clients.

II) No warranty is made with respect to the accuracy of any information provided to bidders regarding auction items, provided in either written or image form, and bidders should rely solely on their own investigation and/or research of the item they place bids on.

III) Neither ParkModelAuctions.com or our consignors make any warranties or representations of any kind or nature with respect to the property in the online auctions or it's value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of it's value. No statement (spoken or written)  in online auction listings or anywhere else shall be deemed such a warranty or representation, or any assumption of responsibility. For online and/or live auctions, the highest bidder reaching the reserve amount for each item shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the disputed item shall be put up again for bid and resold.

IV) Internet bidding through our Technology Provider is offered as a service to our customers, and prospective bidders shall not hold the auctioneer or his staff responsible for any failure due to the loss of the auction service supplied to ParkModelAuctions.com by the Technology Provider. Furthermore, we shall not be held liable for interuptions or loss of service of the Internet, or system failures of the bidder, or their internet provider, or due to unforseen acts of nature.
